All digital product sales are final.

Due to the nature of digital downloads:

• No refunds are issued once access is delivered.

• Digital products may not be shared, resold, copied, or redistributed.

Unauthorized distribution is strictly prohibited.

5. Physical Products & Print-on-Demand Items

Painting kits, artwork, and print-on-demand items are fulfilled either directly by Tipsy Artist® or through Printful.

Shipping timelines may vary.

If your item arrives damaged:

• You must contact us within 7 days of delivery.

• Photos of damage may be required.

We are not responsible for delays caused by carriers.

6. Class Registrations

When registering for painting classes:

• Registration secures your seat in the class.

• Cancellations and rescheduling policies may vary by event.

• No-shows may forfeit registration fees.

• Private event terms may be governed by a separate agreement or invoice.

We reserve the right to cancel or reschedule classes due to low enrollment, emergencies, or unforeseen circumstances.

7. Intellectual Property

All content on this website, including:

• Artwork

• Class materials

• Digital downloads

• Logos

• Branding

• Videos

• Written content

is the intellectual property of Tipsy Artist® and Tiffany Bohrer.

You may not reproduce, copy, distribute, or commercially exploit any materials without written permission.

Tipsy Artist® shall not be liable for any indirect, incidental, or consequential damages arising from:

REFUND POLICY

Effective Date: February 28, 2026

Tipsy Artist® values customer satisfaction while also protecting the integrity of our digital and creative products. Please review our refund policy carefully before making a purchase.

1. Digital Products (No Refunds)

All sales of digital products are final.

This includes but is not limited to:

• Downloadable artwork

• Digital painting templates

• Online class recordings

• Workbooks

• Courses

• Masterclasses

• Educational materials

Because digital products are delivered instantly and cannot be returned, we do not offer refunds, exchanges, or credits once access has been granted.

If you experience technical issues accessing your purchase, please contact us and we will assist you.

2. Online Courses & Coaching Programs

Due to the immediate access to proprietary materials, templates, and training content:

• All online course and coaching program sales are final.

• No refunds will be issued after enrollment.

• Payment plans remain binding agreements.

If a live program includes a stated satisfaction guarantee in writing, that guarantee will govern that specific program.

3. In-Person Classes

Class registrations secure your seat in a scheduled event.

• No-shows forfeit their registration fee.

• Cancellations made at least 48 hours prior to class may receive a credit toward a future class (at our discretion).

• Same-day cancellations are non-refundable.

Private event policies may be governed by a separate signed agreement.

Tipsy Artist® reserves the right to cancel or reschedule classes due to low enrollment or unforeseen circumstances. In such cases, customers will receive either:

• A full refund, or

• A class credit.

4. Physical Products (Painting Kits, Artwork, Merchandise)

If your item arrives damaged:

• You must contact us within 7 days of delivery.

• Photos of the damage are required.

• Replacement or refund decisions are made at our discretion.

We do not issue refunds for:

• Minor variations in print color

• Shipping delays caused by carriers

• Incorrect addresses provided by the customer

5. Print-on-Demand Products (Printful Fulfillment)

Products fulfilled by Printful are custom made to order.

Because these items are printed specifically for you:

• Returns and exchanges are not accepted for buyer’s remorse, incorrect sizing selection, or change of mind.

• Damaged or defective items must be reported within 7 days of delivery.

• Photo documentation is required.

Replacement eligibility is subject to Printful’s fulfillment policies.

6. Chargebacks & Payment Disputes

If you initiate a chargeback without contacting us first:

• You agree to provide written documentation of the dispute.

• We reserve the right to provide evidence of delivery, access logs, and purchase agreements to the payment processor.

Fraudulent chargebacks may result in permanent refusal of future service.

Print-on-Demand Fulfillment

Certain products offered on this website are fulfilled by a third-party print-on-demand provider, Printful.

By purchasing print-on-demand products, you acknowledge and agree:

• Items are custom produced at the time of order.

• Production and shipping timelines are determined by Printful.

• Tipsy Artist® is not responsible for manufacturing delays beyond our control.

• Color variations may occur due to screen differences and printing processes.

• Claims for damaged or defective items must be submitted within 7 days of delivery with photographic evidence.

Refunds or replacements for print-on-demand items are subject to Printful’s policies and approval.

Tipsy Artist® is not liable for carrier delays, customs delays, or force majeure events.

Coaching, Masterclasses & Educational Programs

Tipsy Artist® offers coaching programs, educational courses, and masterclasses designed to provide creative and business guidance.

By enrolling in any coaching or educational program, you acknowledge:

1. No Guarantees of Results

We make no guarantees regarding income, business success, artistic skill level, or financial outcomes.

Results depend on individual effort, experience, background, and market conditions.

Testimonials represent individual experiences and are not promises of future performance.

2. Educational Purpose Only

All content provided is for educational and informational purposes only.

Nothing provided constitutes:

• Legal advice

• Financial advice

• Tax advice

• Medical advice

You are responsible for consulting qualified professionals before making business or financial decisions.

3. Intellectual Property Protection

All coaching materials, recordings, templates, downloads, worksheets, and curriculum are proprietary intellectual property of Tipsy Artist®.

You may not:

• Share login credentials

• Resell

• Distribute materials

• Teach our curriculum as your own

Violation may result in removal from the program without refund and possible legal action.

4. Payment Plans

If enrolling under a payment plan:

5. Confidentiality (Group Programs)

Participants agree not to disclose confidential business information shared by other members in group coaching environments.

Photo & Media Release

By registering for and attending a Tipsy Artist® class, workshop, or private event, you grant Tipsy Artist® and Tiffany Bohrer permission to:

• Photograph

• Video record

• Livestream

• Capture audio

during the event.

You understand and agree that:

• Images and recordings may be used for marketing, promotional materials, social media, website content, advertisements, email marketing, and educational products.

• No compensation will be provided for the use of such media.

• You waive any right to inspect or approve final materials.

• All media becomes the property of Tipsy Artist®.

If you prefer not to appear in photos or video, you must notify us in writing before the event begins.

2️⃣ LIABILITY WAIVER FOR IN-STUDIO PAINTING EVENTS

(To Include in Registration Confirmation + Posted in Studio)

Assumption of Risk & Liability Waiver

By participating in any Tipsy Artist® class or event, you acknowledge and agree:

• You are voluntarily participating in an activity involving paint, art supplies, tools, easels, and studio equipment.

• You assume all risks associated with participation, including but not limited to:

  • Spills

  • Slips or falls

  • Allergic reactions to materials

  • Minor injuries from tools or equipment

You agree to:

• Follow all safety instructions provided.

• Use materials responsibly.

• Supervise any minor children in your care.

To the fullest extent permitted by Oklahoma law, you release and hold harmless:

from any claims, liabilities, damages, or expenses arising from participation.

If you are registering a minor, you certify you are the parent or legal guardian and consent to their participation.
